Welcome to www.JumpPost.com (the “Site”), a website operated by JumpPost, Inc. (“JumpPost, Inc.”) for use by Residence Resource Ltd. (“Residence Resource”), a registered New York real estate broker.  Collectively, JumpPost, Inc. and Residence Resource will be referred to as “we”, “us” or “our”.  We know you are concerned about your privacy, so we developed this Privacy Policy to explain how we collect, use, and disclose information from and/or about you. We provide our visitors and members (collectively, “you” or “your”) an online marketplace for residential, rental properties in New York City – actually a pre-marketplace, as explained in our Terms of Use – and a number of related services (collectively, the “Services”).  The Services include discount real estate brokerage services that are provided by Residence Resource, not JumpPost, Inc. 

By registering with the Site and/or using the Services, you are consenting to our collection, use and disclosure practices described in this Privacy Policy.  This Privacy Policy describes our practices for: a “Visitor” (which means that you simply browse the Site); a “Member” (which means that you have established an account with JumpPost.com (your “Account”)); a Member who posts a “JumpPost”, which is a classified listing of an apartment that such Member will vacate within six months; and an individual who reads the JumpPosts and may potentially lease the property described in any JumpPost.

YOUR PERSONAL INFORMATION MAY BE PROCESSED BY US IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.

So we are clear about the terminology we are using, when we use the phrase “Personal Information” in this Privacy Policy, we mean information about you that is personally identifiable to you, like your Contact Information, and other non-public information that is associated with your such information (but specifically excluding your Applicant Information and JumpPost Information, each as defined below). “Contact Information” in this Privacy Policy means your name, physical address, e-mail address, and phone number(s). When we use the phrase “Anonymous Information” in this Privacy Policy, we mean information that is not associated with or linked to your Personal Information. Anonymous Information does not enable identification of or contact with individual persons.

Children.

The Site is not directed to children and children are not eligible to use our Services.  Protecting the privacy of children is very important to us.  We do not collect or maintain Personal Information from people we actually know are under 18 years of age, and no part of our Site or Services is designed to attract people under 18 years of age. If we later learn that a user is under 18 years of age, we will take steps to remove that user's Personal Information from our databases and to prevent the user from utilizing the Site and the Services.

 

How We Collect Information. 

Personal Information

In general, the Personal Information we gather from you helps us learn more about the use of the Site and/or Services. We collect Personal Information that you submit to us voluntarily. When you register with us or otherwise establish an Account, we may ask you to provide certain Contact Information and other Personal Information. We may request optional information to support your access to the Site or Services. When you communicate with us by sending us an email, or otherwise complete online forms or surveys, we will collect and store any information that is contained in your communications with us.  You can choose not to provide us with certain information, but this may limit the features of the Site or Services you are able to use.

 

JumpPost Information

If you submit a JumpPost, we will require you to provide your expected move-out date and certain details about your apartment, including monthly rent, number and type of rooms and bathrooms and neighborhood (collectively, your “JumpPost Information”). JumpPost Information may also include photographs and other multimedia that you may, but are not required to, provide with your JumpPost. As your JumpPost Information is intended by you to be published on the Site, your JumpPost Information will not be considered Personal Information under this Agreement and we may use and disclose the JumpPost Information without restriction. If we require you to provide your landlord’s contact information for your JumpPost, such information will be considered Personal Information and not JumpPost Information.

 

Applicant Information

In the event you wish to apply to live in a property listed in a JumpPost, we will require you to provide your Applicant Information. “Applicant Information” means your Contact Information and other information that is required to process a rental application, including, but not limited to, your date of birth, social security number, ID or driver’s license number, salary/income, rental history, employment history, criminal background, references, and pets (if any). We may also ask for certain documentation related to your Applicant Information, including, but not limited to: (i) your most recent pay stubs, tax returns, and bank statements; (ii) a copy of your driver’s license; and (iii) a verification of employment letter from your employer (such materials shall also be considered “Applicant Information”). We may ask for additional information or materials if you apply for certain properties, based on the requirements of the landlord of such property, in which case such information and/or materials will be considered Applicant Information, regardless of the type or character of the information or materials.

 

We may receive additional Applicant Information from, or we may seek to verify certain Applicant Information with, third parties that you list in your Applicant Information, including your bank, employer, current landlord and personal references. We may also receive Applicant Information from vendors that provide us credit reports or criminal histories. In the event we receive additional information about you from any such third parties, any such information disclosed or otherwise learned by us shall be considered Applicant Information for the purposes of this Agreement and not Personal Information, regardless of the type or character of such information.

 

Anonymous Information

As you use the Site or Services, certain Anonymous Information may be passively collected and stored, such as your Internet protocol address, domain names, browser type, and access times.  JumpPost, Inc. may also use Cookies (as defined below) and navigational data like Uniform Resource Locators (URLs) to gather information regarding the date and time of your visit and the solutions and information for which you searched and viewed. “Cookies” are small pieces of information that a website sends to your browser while you are viewing a website.  JumpPost, Inc. may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your browser until you delete them) to improve your experience on the Site (e.g., by keeping you logged in).  Persistent Cookies can be removed by following your Internet browser help file directions.  If you choose to disable Cookies, you may be logged out of the Site after each visit.

 

We may contract with third party service providers to help manage and optimize our Internet business and communications. For example, we may use the services of a marketing company to help us measure the effectiveness of our advertising and how visitors use our Site. The information collected helps us learn things like what kinds of customers our Site attracts and what kinds of offers our customers like to see.

 

We may also enable advertisers and ad servers to promote third-party products and/or services by placing advertisements on the Site.  These advertisers and ad servers may use Cookies and/or web bugs (which are usually small, transparent graphic images) in order to monitor information related to served advertisements.  Clicking on such advertisements will direct you to the website of a third-party and the advertiser.  This Privacy Policy does not cover the privacy practices of any advertisers or ad servers.

 

How We Use Information. 

Personal Information

We will use your Personal Information to:

·       Administer your Account;

·       Provide you with Services and customer support;

·       Tailor the features, performance and support of the Site or Services to you;

·       Customize the advertising you may see on the Site or through the Services

·       To market our products and services to you and those of third parties we believe may be of interest to you

·       Collect and/or distribute money;

·       Respond to your requests, resolve disputes and/or troubleshoot problems;

·       Verify your compliance with your obligations in our Terms of Use;

·       Improve the quality of the Site and the Services; and

·       Communicate with you about the Site and the Services

 

We may also use your Personal Information to create Anonymous Information records by excluding information (such as your Contact Information) that makes the information personally identifiable to you. You can opt out of receiving certain communications from the Site by clicking the “Unsubscribe” link at the bottom of each email. Please note that even if you unsubscribe or opt-out, we may still send you Site and Service related communications (e.g., emails related to your JumpPost).

 

JumpPost Information

We will post your JumpPost Information on the Site, and we may use your JumpPost Information without restriction.

 

Applicant Information

We will use your Applicant Information solely as necessary to provide the Services to you.  For example, in the event you wish to apply to live in a property listed in a JumpPost, we will verify and compile the necessary Applicant Information for such property. Residence Resource, as your broker, will submit your Applicant Information to the landlord of the property in such JumpPost.

 

Anonymous Information

We may, through our use of Cookies, keep you logged into our Site, track your session history and collect your click-stream data. With your consent, JumpPost, Inc. can combine such data with certain of your Personal Information. JumpPost, Inc. may use Anonymous Information records created from your Personal Information, and other Anonymous Information, to analyze usage patterns so that we may enhance the Site or Services, improve our internal operations and the content of our software, notify visitors about updates to our Site or Services, and customize the content and advertisement that appear on the Site.

 

How We Disclose Information.

Personal Information

We may disclose certain Personal Information:

·       To third party vendors who help us provide the Services or the Site;

·       To third parties to whom you ask us to send Personal Information (including other Members);

·       To a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), in the event we have such Affiliates in the future, in which case we will require our Affiliates to honor this Privacy Policy;

·       To a company that merges with us, acquires us, or purchases our assets, in which case such company may continue to process your Personal Information as set forth in this Privacy Policy; or

·       If we believe in good faith that such disclosure is necessary to (a) resolve disputes, investigate problems, or enforce our Terms of Use; (b) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity, in which case we can (and you authorize us to) disclose Personal Information without subpoenas or warrants served on us; or (c) protect and defend our rights or property or the rights and property of you or third parties.

 

We do not disclose the Personal Information of any Member who posts a JumpPost to any another Member.  We do, however, provide other Members with the opportunity to communicate with you through an anonymous in-browser message box. If you respond to any in-browser message, you will be providing the recipient your email address.

 

JumpPost Information

This is a community-oriented Site.  If you post a JumpPost, you are welcome to share as much JumpPost Information as you think is necessary and appropriate. But please be aware than any JumpPost Information will be made available to any Member or Visitor to the Site.

 

Applicant Information

In the event you apply to live in a property listed in a JumpPost, we may disclose your Applicant Information:

·       To third parties to verify the accuracy of your Applicant Information, but only to the limited extent required to each such party;

·       To our vendors to run credit checks and/or criminal histories, but only the information necessary for the completion thereof;

·       To an Affiliate, in the event we have such Affiliates in the future, in which case we will require our Affiliates to honor this Privacy Policy;

·       To a company that merges with us, acquires us, or purchases our assets, in which case such company may continue to process your Applicant Information as set forth in this Privacy Policy; or

·       If we believe in good faith that such disclosure is necessary to (a) resolve disputes, investigate problems, or enforce our Terms of Use; (b) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity, in which case we can (and you authorize us to) disclose Applicant Information without subpoenas or warrants served on us; or (c) protect and defend our rights or property or the rights and property of you or third parties.

 

Residence Resource will provide your Applicant Information to the landlord(s) of a property in a JumpPost for which you wish to apply, but only to the extent such information is required by such landlord. Residence Resource will use your Applicant Information only as necessary to fulfill its responsibilities as your broker.

 

Anonymous Information

We may disclose Anonymous Information to:

·       Third party vendors who may help us enhance or provide the Site or Services; or

·       Third parties to whom you ask us to send Personal Information.

 

Invitations to Non-Members

Members or Visitors can invite their friends to become Members by sending invitation emails via our Site. We store the email addresses that are provided to us and, if they are provided by a Member, we will associate those email addresses with such Member’s Account. We do not currently sell these email addresses or use them to send any other communication besides invitations (unless the email address is used in registration by a new Member) but we may do so in the future. Recipients of invitations may contact us to request that we refrain from sending them emails or to have us delete their information in accordance with the succeeding section.

 

Accessing And Controlling Your Information.

You can review and change the Personal Information in your profile, certain of your Applicant Information, and/or any JumpPost Information you have posted by logging into the Site and accessing your Account.  You must promptly update any information that you have provided to us (including your Personal Information, Applicant Information and/or JumpPost Information) if it changes or becomes false or inaccurate. You authorize us to use and disclose any new or modified information that you provide in accordance with this Privacy Policy, and you agree that we are under no obligation to delete or modify information that you have previously chosen to provide us.  Please remember, however, if we have already disclosed some of your Personal Information, Applicant Information or JumpPost Information to third parties, we cannot access that Personal Information, Applicant Information or JumpPost Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.

 

Upon your request, we will close your Account and remove your JumpPost from the Site as soon as reasonably possible, in accordance with applicable law. Unless you otherwise opt-out, we will continue to use your Personal Information in accordance with this Privacy Policy even after we have closed your account.  If you opt-out, we may retain the Personal Information to comply with laws, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and take other actions otherwise permitted by law.

 

Information Disclosed to Third Parties

This Privacy Policy addresses only our use and disclosure of information we collect from and/or about you. If you disclose information to others, including to other Members, the use and disclosure restrictions contained in this Privacy Policy will not apply to any third party.  We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

 

The Site may contain links to other websites that are not owned or controlled by us. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site.  During this process, another entity may collect Personal Information or Anonymous Information from you.

 

Changes to this Privacy Policy.

This Privacy Policy is subject to revision from time to time on a going-forward basis.  We will post any revised version of the Privacy Policy on this page.  If we make any material changes to it, we will also send you notice thereof to the last email address you have provided to us.  Continued use of our Services following notice of such changes will indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
